Important – Terms & Conditions of Hire – Please Read

In these conditions ‘owner’ means ‘registered carrier’. ‘Hirer’ means person or company to which accounts are rendered. Vehicle means the vehicle which is being used to deliver or collect the skip which is subject to the contract. ‘Driver’ means the driver of the vehicle and ‘site’ means the place where the skip is being deposited with the guidance and direction of the hirer. The following conditions must be upheld throughout the contract:

1. Please ensure the skip/container is loaded safely and that the weight is evenly distributed. Over loaded containers will not be collected and additional charges will be levied to cover additional transport/disposal costs. If the driver should feel that the load is unsafe he/she has the authority to tip off any excess at his/her discretion. Once the skip or bin is delivered, it must not be moved otherwise it may be impossible to lift or access.

2. The customer shall ensure free and suitable access to and from the delivery address and ensure suitable ground conditions for the delivery of equipment or heavy vehicle movements. No responsibility will be accepted for the damage to any surface over which the equipment or vehicle is moved to reach its destination and the customer should therefore take steps to protect the surface.

Customers should be aware that the damage could occur when they vehicles are instructed to leave the public highway. The most common cause of problems are:-

2.1 It is unlikely that the private driveways re constructed to take the weight of a laden Skip Lorry so there is a probability that damage could occur when the loaded skip is collected.
2.2 Access to domestic property is not normally of a width to allow easy access for a large vehicle therefore when manoeuvring some damage could occur to property )gate piers etc.)
Although our employees will take every precaution to avoid any damage, as detailed, the company will not accept liability for any damage caused when delivering or collecting containers which are not on the public highway.

3. Enclosed containers must not be filled so that the lid cannot be secured or in such a way as the waste becomes difficult to tip out. Additional charges will be levied to cover additional tipping costs.
3.1 Any damage caused to Enclosed containers will be payable by the hirer.

4. The hirer, their agent or employees must not place any hazardous waste or chemicals into the container without first seeking the consent of the Company. This includes but is not limited to: oils, solvents, paint, acids, batteries, gas bottles, tyres, fridges, astro turf, roofing felt and plasterboard. Should those materials end up in a skip without prior arrangement, there is the possibility that an excess charge will be applied to cover the disposal cost.

5. The container is hired out for 21 days unless otherwise requested. Rental charges will apply for extended periods.

6. During the entire period of the hire, the hirer shall ensure that:
6a. No damage occurs to the container
6b. No flammable material is placed in the container,
6c. No FIRES are lit in or near the container,
6d. The container is not stolen,
6e. If the container is located on the public highway reasonable precautions are taken to ensure that the skip does not cause an obstruction and that any lights or cones supplied are kept clean and fit for purpose.

7. Unless specifically agreed in advance payment is to be made in full at the time of the initial placement of the container. No consideration for credit will be given without completion of the Company’s Account Application form.

8. Wasted journeys are charged at: Zone 1 £60, Zone 2 £80, Zone 3 £100 for skips or the haulage costs for RORO. Skips and bins must contain a level load and overloads may incur a surcharge ranging from £20 upwards. Collections will generally be made within 3 working days.

9. All skips shall be indelibly marked with the Enterprise Skip Hire’s name and number.

10. Except when specifically, otherwise agreed, Enterprise Skip Hire will dispose of the contents of the skip. All waste will be taken to our treatment centre for sorting before transferring any remaining, non-recyclable material to a licensed waste disposal site.

I/WE CONFIRM THAT I/WE HAVE FULFILLED MY /OUR DUTY TO APPLY THE WASTE HIERARCHY AS REQUIRED BY REGULATION 12 OF WASTE (ENGLAND AND WALES) REGULATIONS 2011.

EXTRACT FROM THE DUTY OF CARE – A CODE OF PRACTICE

C1. The Environmental Protection (Duty of Care) Regulations 1991 (made under section 34) (5) of the Act) require all those subject to the duty to make records of waste that they receive and consign, keep the records and make them available to waste regulations authorities.

C2. The regulations also require the parties to complete, sign and keep a transfer note. The transfer note contains information about the waste and about the parties involved in the transfer.

C3. While all transfers of waste must be documented, nothing in the regulations requires each individual transfer to be separately documented. In the case of for example, weekly or daily collections of waste from outside shops or commercial premises or the removal of a large heap of waste by multiple lorry trips this would be unrealistic because of the number of individual loads and the absence of any necessary contact between the parties to one transfer. It is therefore reasonable for a single transfer note to cover multiple consignments of waste transferred at the same time or over a period (not exceeding a year) provided that the description and all other details on the transfer note (who and what the parties are) are the same for all consignments covered by that note. A single transfer note would not cover a series of transfers between different holders nor transfers of wastes of different descriptions.

C4. The regulations require these records (both the descriptions and the transfer notes) to be kept for at least three years. Holders must provide copies of these records if requested by any waste regulations authority.

C5. One purpose of documentations is to create an information source of use with other holders. It is open to holders to ask each other for details from records
